Heard Sri Vijay Singh Gaur, learned counsel for the petitioner, Sri Rajendra Kumar Mishra for respondent no.4 and the learned Standing Counsel.
The petitioner is seeking a writ of mandamus commanding the respondent nos.3 and 4 to consider the application dated 4.7.2020 pending for refunding collected amount towards electricity duty.
The petitioner obtained an industrial electricity connection no. 003070 having 54 KVA load from respondent no.5, which was energized on 15.9.2009.
It is submitted that under law, the petitioner was entitled to exemption for the reasons stated in paragraph-8 of the writ petition, in respect of which the petitioner submitted a representation dated 4.7.2020 before respondent no.3, but the same has not been disposed of till date.
Sri Rajendra Kumar Mishra, learned counsel for respondents concerned submits that no useful purpose would be served by keeping this petition pending, same be disposed of by giving appropriate directions to the authority concerned.
The writ petition is disposed of with the direction to respondent concerned to decide the representation dated 4.7.2020, or a fresh representation, as the case may be, as expeditiously as possible, preferably within 6 weeks from today by a reasoned and speaking order under intimation to petitioner.
