Heard learned counsel for the petitioner and learned standing counsel for State-respondents.
Learned counsel for the petitioner prays for and is permitted to implead District Programme Officer, Mirzapur as respondent No. 6 during the course of the day.
Pursuant to the order of this Court dated 09.09.2021, learned standing counsel has produced instruction dated 23.09.2021, which is taken on record. Learned standing counsel has produced order dated 23.09.2021, which is part of instruction, by which suspension of petitioner has been revoked with direction to conclude inquiry. He next submitted that now petition may be dismissed as infructuous.
Learned counsel for the petitioner has no objection to the submissions made by learned standing counsel, but submitted that a suitable direction may be issued to respondent no. 6 to pay full salary to the petitioner from month to month basis forthwith.
Therefore, under such facts and circumstances, this petition is dismissed as infructuous with direction to respondent no. 6 to pay full salary to the petitioner on month to month basis forthwith.
