Heard learned counsel for the applicants and perused the order dated 28.8.2014 in Application under Section 482 Cr.P.C. No. 34523 of 2014 (Prakash Chand @ Bobi Vs. State of U.P. and another) wherein the proceeding as against applicant Prakash Chand @ Bobi arising out of impugned order dated 27.6.2014 in S.T. No. 11 of 2014 (State Vs. Prakash Chand @ Bobi) was stayed and the order of trial Court dated 2011.2018 whereby Prakash Chand @ Bobi and Surendra Nath was directed to appear and apprise about the order, if any, regarding the extension of stay order by this Court before trial was passed.
Admittedly, this Sessions Trial Court and the impugned order in it was challenged before this Court in above proceeding under Section 482 Cr.P.C. and the trial was stayed against accused regarding impugned order dated 27.6.2014.
Hence, the above Court is to decide the proceedings of Application under Section 482 Cr.P.C. No. 34523 of 2014 and the stay order does not vacate automatically, hence, this petition is being placed with previous petition for disposal by appropriate Bench. Meanwhile, the Sessions Judge is directed to obey the interim order dated 28.8.2014 of this Court till any further order by above Bench.
