Petitioner claims the owner ship and possession in respect of property situated in Sy.No.156/10-1 and in Sy.No.189/2A2 of the Manjalloor Village in Muvattupuzha Taluk. It seems that the petitioner has obtained the property from his father. The other legal heirs of his father also has released this right in favour of the petitioner. The petitioner claims to be exclusive ownership and possession of the above property. It appears that there are revenue recovery proceedings against the father of the petitioner and on account of the above, the revenue officials refused to effect mutation and accept basic tax. The initiation of proceedings under Revenue Recovery Act is not a bar or impediment in effecting transfer of registry and the right available to the creditor will not be lost on account of effecting mutation. 2. In view of the above, the 3rd respondent is directed to W.P.(C).No.24948 of 2014 2 effect mutation in respect of the property claimed by the petitioner as per Ext.P1 document and other document and also to accept land tax. However it is made clear that this will be subject to any revenue recovery proceedings against his father.
Writ petition is disposed of.
