JUDGMENT / ORDER

Application filed under Section 438 of the Code of Criminal Procedure.
2. Petitioner is the 3rd accused in Crime No.914 of 2014 of the Walayar Police Station. It seems that when the petitioner had approached the court below for anticipatory bail through Crl.M.P.No.3344 of 2014, the court below vide order dated 29.10.2014, had permitted the petitioner to surrender before the investigating officer within eight days from 29.10.2014. The petitioner could not surrender before the investigating officer on that day.
3. Considering the facts narrated by the learned counsel for the petitioner, I am of the view that such an opportunity can once again be granted to the petitioner and therefore, the period of eight days granted by the court below to the petitioner to surrender before the investigating officer can be modified as:- “within a week from today”. 2 directions granted by the court below and the observations made in the said order will follow.
This bail application is disposed of by permitting the petitioner to surrender before the investigating officer “within a week from today” as aforesaid.
