(Per : HONOURABLE MR.JUSTICE C.L. SONI) Applicant has prayed for condoning the delay of 866 days in filing first appeal. The applicant has stated in the application that previously Special Civil Application was filed challenging the judgment and award passed by the reference court. However, the said petition was withdrawn and review application was filed before the Reference Court. After the review application was disposed of, the applicant was advised to challenge the judgment and award passed by filing appeal before this Court. Accordingly, in the process, delay has caused in filing the appeal. We are satisfied with the explanation given in the application. We, therefore, allow this application and condone the delay of 866 days in filing the first appeal. Rule is made absolute accordingly.
