Heard learned counsel for the petitioner, learned Standing Counsel for respondents no.1 & 4 and Sri B.P. Singh, learned counsel for the respondents no.2 & 3.
The petitioner is working as Shikshamitra in Prathmik Vidyalaya, Aaraji (Ibrahimpur), Block Mahrajganj, District Azamgarh.
It appears that the petitioner had gone on leave and when he came back to join the School, he was not allowed to join in the School on the pretext that there is an order passed by the District Basic Education Officer, Azamgarh dated 20.12.2019 directing the Block Development Officer, Maharajganj to issue show cause notice to the petitioner, and the petitioner has been restrained from joining in the School by the said order. He further submitted that the petitioner has been illegally denied from discharging his duties as Shikshamitra.
The petitioner has submitted a representation dated 07.05.2019 (Annexure No.5 to the writ petition) to the respondent no.3/District Basic Education Officer, Azamgarh.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending, and an appropriate direction be issued to respondent no.3 to consider and decide the representation of the petitioner.
Considering the facts and circumstances of the case, without going into merits of the case and with the consent of the parties, the writ petition is disposed off with direction to the respondent no.3/District Basic Education Officer, Azamgarh to consider and decide the representation of the petitioner dated 07.05.2019 expeditiously preferably within a period of two months from the date of production of certified copy of the order.
With the aforesaid observations, the writ petition is disposed off.
