Heard Sri Surendra Kumar Chaubey, learned counsel for the petitioner and the learned counsel for the respondents.
The relief claimed in this petition is for a direction to the respondent no. 2 (District Magistrate), Kushinagar to decide the appeal, under Section 67(5) of U.P. Revenue Code, 2006 dated 28.10.2020 as expeditiously as possible on its own merits.
This prayer is not opposed by Sri Sunil Kumar Singh, learned standing counsel for the State.
Accordingly, this petition is disposed of with a direction to the respondent no. 2 (District Magistrate), Kushinagar to consider and decide the appeal within 90 days from the date of receipt of computer generated copy of the order being passed today in PDF Form on its own merits.
It is made clear that this Court is not expressed any opinion on the merits of the case of the petitioner.
Accordingly, this petition is disposed of.
