Heard learned counsel for the petitioner and Sri Vikas Rastogi, Advocate holding brief of Sri Sunil Kumar Dubey, learned counsel for the respondent nos.2 and 3.
Challenge has been raised to the recovery of Rs.45,041/- being pressed against the petitioner towards electricity dues.
At the outset, solitary prayer made on behalf of the petitioner is that the petitioner is willing to pay the entire amount in installments.
In view of the offer made by the petitioner, no useful purpose would be served in keeping the present petition pending or calling for a counter affidavit, at this stage.
Accordingly, the writ petition is disposed of with the following directions:
(i) the petitioner shall pay a sum of Rs.15,041/- before the respondent-Corporation on or before 30 November 2021;
(ii) the balance amount may be paid in three equal installments of Rs.10,000/- each payable on or before 31 December 2021, 31 January 2022, 28 February 2022 respectively.
However, it is provided that when the amount due against the petitioner is deposited, the respondent-competent authority may issue No Dues Certificate to the petitioner and also allow him to seek revival of electricity connection.
No coercive measure shall be adopted against the petitioner with respect to the recovery of aforesaid amount, subject to his compliance with the terms of this order.
