Heard Sri Prashant Singh, learned counsel for the petitioner, learned Standing Counsel for respondent no. 1 and Sri Mahboob Ahmad, learned counsel for the respondents no. 2 & 3.
The petitioner in the writ petition is seeking quashing of the demand notice dated 27.08.2018 whereby an amount of Rs.446319/- has been sought to be recovered from him towards electricity dues.
It is stated by learned counsel for the petitioner that the petitioner was given a show cause notice dated 31.7.2018 to which he also submitted a reply but his objection dated 5.9.2018 has not been decided till date.
Learned counsel for the respondents no. 2 & 3 on the other hand submits that the objection of the petitioner has been rejected by the competent authority by order dated 29.10.2018. The copy of the order has been placed on record of the Court.
Learned counsel for the petitioner states that he has no knowledge of this order. A copy of this order has been given to him also for his information.
Learned counsel for the respondents no. 2 & 3 further states that against the impugned order, the petitioner has a remedy by way of appeal under Section 127 of the Electricity Act, 2003.
In this view of the matter, the writ petition is dismissed.
The petitioner may avail the remedy under Section 127 of the Electricity Act, 2003.
