JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)
1. Learned Advocate Mr.B.S.Patel for respondent No.4 files affidavit of one Shri Manishkumar Patel, son of Shri Dilipbhai Patel, Chairman of respondent No.4-Society. Along with the affidavit, resolution No.2 passed by the Managing Committee in its meeting held on 27.03.2012 is produced. The relevant part of the affidavit reads as under:-
"I state that the managing committee of respondent No.4 society, just to have the election of the market committee have decided voluntarily on their own, not to cast vote in the ensuing election of the Petlad market committee and the managing committee has got no objection if their names from the voters list is to be deleted by the authorized officer."
2. In view of this, the grievance of the petitioner does not survive. The petition is disposed of accordingly.
3. Consequent upon the aforesaid affidavit filed by the Chairman of respondent No.4-Society, it will be open for the Director, Agricultural Marketing & Rural Finance, Gujarat State, to delete the names of the Members of the Managing Committee of respondent No.4 from the voters' list.
4. At the request of the learned Senior Advocate for the petitioners, it is clarified that it will be open for the petitioners to pursue other objections in accordance with law, including that of against candidature of Shri Barot Manishkumar Dilipbhai (respondent No.5) as a member of Ramol Fruit and Vegetables Producers Cooperative Society Ltd.
It goes without saying that the society will have right to reply to these objections in accordance with law.
