1. Learned APP was granted time to produce statement of the Doctor who is supposed to undertake the operation of the mother of the convict. Learned APP makes available for perusal a communication dated 15.06.2012 along-with a certificate issued by the Doctor on 15.06.2012 reiterating the ailment suffered by the mother of the convict. It is also mentioned of the second certificate that the earlier certificate dated 07.06.2012 is a genuine certificate.
2. The learned APP has invited attention of the Court to the jail remarks. The convict has enjoyed temporary bail on three different occasions, unfortunately, every time for the treatment of his mother and twice for the operation of his mother and has enjoyed two furlough's. He has reported in time. Nothing adverse is noticed from the convict's jail remarks.
3. For the contents of the application, the same is allowed. The convict is allowed to be released on temporary bail for a period of 30 (thirty) days from the date of his release on his executing a personal bond of Rs.5000/- (Rupees five thousand only) to the satisfaction of the jail authorities.
4. The convict shall surrender himself to the jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
