This application has been filed by the applicants (original respondents of Special Civil Application No.5307 of 1995), with a prayer to fix an early date of final hearing for the said petition.
Heard Mr.Harish Soni, learned advocate for Mr.S.P.Majmudar, learned advocate for the applicants and Mrs.Farhana Y.Mansuri, learned advocate for the opponents (original petitioners) and perused the averments made in the application.
It is submitted by the learned advocate for the applicants that the petition has been filed in the year 1995, challenging the order dated 24.03.1995, passed by the Gujarat Revenue Tribunal. That, a stay order has been granted by this Court in favour of the opponents (original petitioners), which is operating against the applicants. Earlier, an application for fixing the early date of hearing had been filed in the year 19987, which came to be rejected vide order dated 31.03.1997. However, as the petition has not been listed on the Board since the last many years, the prayer made by the applicants may be granted.
Having heard the learned counsel for the respective parties, and in view of the fact that the petition has been filed in the year 1995, the following order is passed:-
The application is allowed. Special Civil Application No.5307 of 1995 be listed on the Board for final hearing on 09.04.2012.
The application is disposed of in the above terms.
