Petitioner is the unmarried daughter born out of the second wedlock of petitioner's late father. The claim for grant of compassionate appointment has been raised on account of death of petitioner’s father in harness on 3.11.2017. It appears that the respondent no. 4 is the step brother of petitioner and has already filed Writ Petition No. 13439 of 2018, wherein direction was issued on 31.5.2018 for the concerned authority to take a decision. It is alleged that such such a decision is still awaited.
In the facts and circumstances of the present case it would be appropriate to permit the petitioner also to raise her claim for grant of compassionate appointment, in terms of the observations already made in the order dated 31.5.2018, and in case a decision has not yet been taken in the matter the authority concerned shall examine the petitioner's claim for appointment also, while considering the claim of respondent no. 4, in accordance with applicable rules, by passing a reasoned order.
With the aforesaid observation, writ petition stands disposed of.
