This application under Section 482 Cr.P.C. has been filed for quashing the order dated 9.8.2018 passed by Ist Additional Sessions Judge, Jalaun at Orai in Criminal Case No. 01 of 2017 ( State Versus Nafees ) arising out of Case Crime No. 133 of 2016, under Sections 363, 366, 376 IPC and 3/C The Protection of Children from Sexual Offences Act, 2012, Police Station Dakor, District Jalaun pending before it and to set the applicant no. 1 at liberty from the confinement in Women Protection Home ( Nari Niketan), Kanpur.
This application filed under Section 482 of Cr.P.C. was confined to not to send applicant No.1 in the Nari Niketan as she has opined before this Court to stay with her husband. The order sending her to the Nari Niketan cannot be continued as prima facie she has already married to applicant No.1.
As the trial is already commenced. The parties may appear before the Authority concerned.
With these observations, this application filed under Section 482 of Cr.P.C. is disposed of.
Applicant No.1 is free to go with her husband or where she likes.
