Petitioner's father was posted as constable in CRPF and has died in the road accident on 25.3.2013. At the time of his death, petitioner was minor aged 13 years. An application for grant of compassionate appointment appears to have remained pending. Attention of the Court has been invited to Annexure-4 to the writ petition, as per which petitioner's claim was forwarded to the concerned authority stationed at Gurugram in Haryana. It is submitted that despite expiry of sufficient time petitioner's claim for grant of compassionate appointment has not been considered.
Sri Purnendu Kumar Singh, learned counsel for the respondent has obtained instructions, copy of which has been placed before the Court.
As per the instructions, there are no vacancies available in the 5% quota meant for compassionate appointment to the post of constable and the petitioner's claim has been kept on hold till the vacancy arises in the category.
Learned counsel for the petitioner states that petitioner is willing to accept compassionate appointment on any other post also considering the financial condition of the family.
In that view of the matter this petition stands disposed of with a direction upon respondent no. 3 to accord consideration tp petitioner's claim for grant of compassionate appointment, in terms of their instructions contained in the letter dated 9.8.2021, copy of which is available on record. As and when any vacancy in the 5% quota arises, respondent shall accord consideration to petitioner's claim. It shall also be open for the respondents to consider petitioner's claim of compassionate appointment on any other post available with the force.
Subject to the above observations made this writ petition stands disposed.
