Heard learned counsel for the petitioner and Sri Shashi Kant Upadhyaya, learned Standing Counsel appearing for the respondents no. 1 to 3 and Sri Manoj Kumar Yadav, learned counsel appearing for the respondents no. 4 and 5.
Present writ petition has been filed seeking a direction to the respondent no. 2 to take appropriate action on the application of the petitioner dated 9.11.2017 filed under Section95 (1) (g) of U.P. Panchayat Raj Act within a stipulated time as directed by this Court.
It is submitted that a complaint duly supported by an affidavit was filed on 9.11.2013 in accordance with Rule 3 of the U.P. Panchayat Raj (Removal of Pradhan, Up-Pradhan and Members) Enquiry Rules, 1997, however, till date the same has not been decided although Rule 3 of the aforesaid Enquiry Rules provides that on a complaint a preliminary enquiry is to be conducted within thirty days.
In the facts and circumstances of the case, this writ petition stands disposed of with a direction to the respondent no. 2, the District Magistrate, Jaunpur to complete the preliminary enquiry within a period of 30 days from the date of production of a certified copy of this order before him as provided in the aforesaid Rules and thereafter pass necessary orders, in accordance with law.
No costs.
