JUDGMENT / ORDER

Heard Ms. Subhadra Patel, learned advocate for the applicant and Mr. M.K. Patel, learned advocate for respondent No.2.
Having regard to the nature of the allegations made in the first information report, prima facie, the provisions of section 506(2) IPC would not be attracted. Sections 323 and 504 IPC are non-cognizable offences. Under the circumstances, the matter requires consideration. Hence, issue rule, returnable on 25th November, 2013. Mr. Himanshu Patel, learned Additional Public Prosecutor, waives service of notice of rule on behalf of respondent No.1 and Mr. M. K. Patel, learned advocate, waives service of notice of rule on behalf of respondent No.2.
