This writ petition has been filed for issuing of mandamus directing the respondent to ensure the fair investigation in Case Crime No. 1795 of 2018, under Sections 147, 148, 308 I.P.C., Police Station- Noida Sector-20, District Gutam Budh Nagar and submitting report u/s 173 (2) Cr.P.C. within fifteen days.
It is alleged that F.I.R. was lodged on 03.11.2018 at 2:22 hours. Although about 26 days have passed but neither the police proceeded the investigation nor arrested the accused.
In the facts of the case, this writ petition is disposed of with the direction to respondent no. 2 i.e. Senior Superintendent of Police, Gautam Budh Nagar to ensure the fair investigation in Case Crime No. 1795 of 2018, under Sections 147, 148, 308 I.P.C., Police Station- Noida Sector-20, District Gutam Budh Nagar and submit the report by Investigating Officer under Section 173(2) Cr.P.C. as early as possible.
