1. Learned APP places on record a medical certificate issued by Medical Officer, Ahmedabad Central Jail, Ahmedabad wherein it is stated that 'He is having complaint of difficulty in breathing. He was examined in ENT camp on 01.02.2012 by regular expert ENT surgeon from Civil Hospital, Ahmedabad and advised surgery for nasal polyp.
He was examined by Dr. Rajesh Vishwakarma (HOU,ENT) at Civil Hospital, Ahmedabad on 07.02.2012, on examination, Deviated Nasal Septum with Bi-lateral nasal polyp mucosa present. He was advised to take "steam inhalation with medicines for 10 days and advised surgery S.O.S...".
2. So far as the certificate from the private doctor is concerned, it is already produced by the applicant - the convict wherein also it is stated "I have examined him on 16.05.2012 for the same. He will be benefited with surgery (Bil FESS + Septoplasty). He requires 15 days rest after surgery.
3. Taking into consideration the contents of the certificate of the Medical Officer, Jail Authorities, this Court is of the opinion that no case is made out and the application is rejected.
4. At the request of learned advocate for the applicant, the jail authorities are directed to see that all regular and required medical treatment is made available to the convict.
