1. The petitioner, the owner of a stage carriage bearing Reg.No.KL-9 K 1990 has applied for re-issue of temporary permit in the route Meenashipuram - Palakkad in the vacancy of stage carriage bearing Reg.No.KL-11 K 9199 as per Ext.P2. Admittedly, Ext.P1 was issued in the name of another person. The vehicle has been transferred to the petitioner and hence the claim for re-issuance of temporary permit.
2. If vacancy of stage carriage bearing registration No. KL/11/K 9199 is still in existence and no other person has applied for a temporary permit to operate a stage carriage in that vacancy, there will be a direction to the respondent to issue a temporary permit of 4 months' duration within three weeks from the date of production of a copy of this judgment by passing appropriate orders on Ext.P2. Needless to W.P.(C)No.30868 of 2014 -:2:-
say, such issuance of temporary permit will be subject to a preferential claim, if any.
Writ petition disposed of as above.
