Heard learned counsel for the applicants, Sri Sachin Kanaujiya, learned counsel for the informant and learned A.G.A for the State.
The instant anticipatory bail application has been filed on behalf of the applicants, Pradeep, Harpal Singh, Rohtas and Shivam, with a prayer to release them on bail in Case No. 1586 of 2020, Case Crime No.417 of 2019, under Sections-342, 323, 308 I.P.C., Police Station-Rabupura, District-Gautam Budh Nagar, during pendency of trial.
There is cross version of the incident.
In view of paragraph 43(3) of the judgement dated 05.04.2021 passed by this Court in Criminal Misc. Anticipatory Bail Application u/s438 Cr.P.C No.2110 of 2021, Shivam Vs. State of U.P. and another, this anticipatory bail application is not maintainable.
It is, accordingly, rejected.
