Heard learned counsel for the petitioner.
Petitioner by the instant writ petition seeks the following relief:
"a. issue a writ order or direction in the nature of mandamus commanding the respondent no. 1 (The District Election Commission Officer/Collector Etah, District Etah to consider the representation dated 4.6.2021 along with reminder application dated 9.6.2021 for rectification of the voter list 2021 concerned to Gram Panchayat Bahgon, Etah as well as quarify the defects in candidature and in nomination of Pradhan candidate Sangeeta (Smt.) wife of Updesh Kumar @ Rinku accordingly.
b. issue a writ, order or direction in the nature of mandamus commanding the Respondent no. 2 (Sub Divisional Magistrate, Aliganj, District Etah) and respondent no. 4 (R.P. Aliganj, Etah), if defect is verified the candidature of Sangeeta (Smt.) the nomination should be cancel and accordingly the result of Gram Panchayat Bahgon should be quashed."
Learned Standing Counsel at the outset submits that at this stage the writ petition is not maintainable. Petitioner has to approach the competent authority under the relevant rules for correction of the voter list.
Learned counsel for the petitioner does not dispute this fact.
In view thereof, the writ petition is disposed of as withdrawn with liberty to the petitioner to approach the competent authority for correction of voter list in accordance with rules.
