Heard learned counsel for the applicant and learned A.G.A. for State.
The present anticipatory bail application has been filed by the applicant with a prayer to enlarge him on bail in Case Crime No. 226 of 2021, under Sections 419, 420, 467, 468, 471, 120-B I.P.C., Police Station Kurawali, District Mainpuri.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. The prosecution story is false and fake. It is further submitted that the applicant is not named in F.I.R. but his name came into light during investigation. He has no concern with the present case. He further submitted that there is no allegation against the applicant and the same has been levelled against the co-accused Pooja Gautam, who is named in F.I.R. If the applicant is enlarged on anticipatory bail, he shall not misuse the liberty of bail and would co-operate with the investigation.
Learned AGA vehemently opposed the application and submitted that although, the applicant is not named in F.I.R. but he has committed the offence as alleged in the F.I.R. with collusion of co-accused Pooja Gautam.
After hearing the learned counsel for the applicant and learned A.G.A., and after perusing the averments made in the present anticipatory bail application as well as rejection order, this Court is of the opinion, no case for anticipatory bail is made out.
Accordingly, the anticipatory bail application filed on behalf of the applicant is hereby rejected.
