Petitioner is Head Assistant in the office of the District Program Officer, Bareilly. He has approached this Court with the grievance that about 68 persons junior to him have been promoted to the post of Administrative Officer but petitioner's claim, till date, has not been considered in that regard.
Submission is that denial of consideration to petitioner's claim for promotion while considering the claim of petitioner's junior, is wholly arbitrary. It is stated that various representations made in that regard have also not been considered.
Learned Standing Counsel submits that an appropriate decision would be taken by the respondent no.2, in accordance with law.
Considering the facts and circumstances, noticed above, this petition stands disposed of with a direction upon the respondent no.2 to accord consideration to petitioner's claim for promotion, keeping in view the applicable provisions of law, within a period of four months from the date of presentation of certified copy of this order. Liberty stands reserved to the petitioner to move a fresh comprehensive representation, annexing all materials in support of his claim. It goes without saying that in case persons junior to petitioner have already been promoted, the claim of the petitioner for grant of promotional benefit from the date his juniors were promoted, would also be examined, if petitioner is otherwise found eligible for promotion.
