Pradeep Raja Anubhavi vs State Of U.P. And Others

High Court Of Judicature at Allahabad|17 June, 2010

JUDGMENT / ORDER

Heard learned counsel for the petitioners and learned Standing Counsel. The petitioners are candidates seeking appointment on the post of police constable in the Police Organization of Uttar Pradesh, had undergone a detailed process of selection/direct recruitment process, which is a condition precedent in the relevant service rules for entering into service of police department. Certain grievances have been raised by the petitioners in respect of the selection process and the result thereof. According to them, candidates having lesser marks have been selected, while the petitioners have been excluded from consideration. The candidates, so selected, are being sent for training.
Earlier, this court has granted indulgence in such matters by rendering a judgment on 28.5.2010 in a bunch of writ petitions, the leading case being 33488 of 2010 and other writ petitions by which this court has provided that the aggrieved person may file objections/representations, annexing all the relevant documents to the appropriate authority of the Examination Board by 3rd June 2010. This deadline is over now, but the representations of such candidates are still pouring in. Attention of the Court has been drawn to yet another order passed by this court on 4.6.2010 in Writ Petition No.33488 of 2010, Alok Kumar and Others Vs. State of U.P.& Others by which the Court has provided that the petitioners of that case may file a detailed representation before the authority concerned and the same may be considered and disposed of by passing a reasoned and speaking order.
In view of above and taking note of the directions contained in the judgment and order dated 4.6.2010 as indicated above, this writ petition is being disposed of with the observations that the petitioners may file a detailed representation immediately within a week from today to the appropriate authority. If any such representation is filed, the same may be disposed of by passing a reasoned and speaking order within a month.
This Court appreciates the anxiety expressed by the learned Standing Counsel, appearing for the respondents, that this unending process may now come to an end so that the Police Department may arrange its affairs at the constabulary level and maintain its appropriate strength to take care of law and order in the State. It has also been brought to the notice of the court that for the Common Wealth Games which are to take place in New Delhi this year, adequate police force is required in National Capital Region (N.C.R). There is already shortage of Police Constables in Uttar Pradesh. It is made clear that the above said exercise has to be completed by 7th July 2010 and this Court may not pass further orders extending the time limit beyond 7th July 2010. With these observations, the writ petition is finally disposed of.
