Heard learned counsel for the applicant.
On 26 May 2017, a writ petition preferred by the applicant was disposed of with the observation that the concerned Assistant Collector would move in the matter with expedition and without granting unnecessary adjournments. From the order sheet, the Court notes that the proceedings have been adjourned on umpteen occasions on account of the lawyers abstaining from work. Additionally, the order sheet does not indicate any deliberate or wilful disobedience on the part of the Assistant Collector. The Court must in this connection also bear in mind the principles enunciated by the Division Bench in Km. Shobha Bose Vs. Judge Small Causes And Others; 2010 (1) ADJ 531 (DB).
On an overall conspectus of the aforesaid facts, the Court finds no ground to initiate proceedings in contempt.
The petition is dismissed.
