JUDGMENT / ORDER

Connect it with Writ Petition No. 44764 of 2011, Sunil Kumar and others Vs. High Court of Judicature at Allahabad and others.
The petitioners are challenging the selection dated 25.7.2011 made by the respondent no. 1 to the post of Assistant Review Officer pursuant to Advertisement No.1/ARO/2009 dated 29.7.2009 mainly on the ground that (i) The reservation is more than 50% as against the total vacancies of 465, the reservation is of 233 seats. (ii) Rule 9 of the Allahabad High Court Officers and Staff (Conditions of Service and Conduct) Rules, 1976 provides that the candidate must possess a Bachelor's Degree of a University established by law in India or a qualification recognized as equivalent thereto. Now by the advertisement the computer knowledge has been added apart from the Bachelor's Degree. (iii) Rule 12 of the aforesaid Rules provides that the merit list shall be prepared on the basis of the marks obtained in the written examination but the computer marks has also been considered while preparing the merit list. Apart from the aforesaid grounds, the other grounds have also been taken.
The matter requires consideration.
Sri Amit Sthlekar, learned counsel for the respondents prays for and is granted three weeks time to file counter affidavit. Rejoinder affidavit may be filed within one week thereafter.
List in the week commencing 19.9.2011.
Till the next date of listing, the selection and appointment shall be subject to the result of the writ petition.
