Heard learned counsel for the petitioners and Shri Kamal Singh, Advocate holding brief of Mohd. Shere Ali, learned counsel for the third and fourth respondents.
The petitioners are before this Court for direction to the fourth respondent i.e. District Basic Eduction Officer, Maharajganj to decide their representation dated 8.1.2018 for counting of previous regular service started from different dates as have been given in the writ petition on the post of Assistant Teacher.
Learned counsel for the parties submits that the controversy involved in the present writ petition is squarely covered by the judgment and order rendered on 19.12.2017 in Service Single No.30890 of 2017 (Shiv Balak vs. State of UP through Secretary, Basic Education, Civil Sectt. Lucknow and others). The operative portion of the order is reproduced herein below:-
"In case such a representation is moved by petitioner, opposite party no. 3 Basic Shiksha Adhikari shall consider and decide the same in accordance with law by a reasoned and speaking order within a period of three months from the date a certified copy of this order along with representation is placed before him.
It is made clear that this court has not expressed its opinion on the merits of the case and all questions are left open to be considered and decided by the competent authority in accordance with law.
With the aforesaid directions, the writ petition is disposed of."
The writ petition is, accordingly, disposed of asking the District Basic Eduction Officer, Maharajganj to decide the representation of the petitioners dated 8.1.2018 within a period of three months from the date of production of certified copy of this order.
