Heard Shri Anubhav Kumar Vimal, learned counsel for the petitioner.
This petition has been filed for a direction to the Additional District & Sessions Judge/FTC, Court No.2/Family Court, Ghaziabad to decide Case No.2221 of 2017 (Pradeep Kumar Yadav v. Pallavi Yadav) under Section 13 of the Hindu Marriage Act expeditiously.
It is the contention of the learned counsel for the petitioner that the application under Sections 13(1)(ia) and 13(1)(ib) of the Hindu Marriage Act was filed for dissolution of the marriage between the petitioner and the defendant-respondent. It is contended that the application was filed on 6 December 2017 but it has not been decided as yet and the defendant-respondent is purposely avoiding to appear before the court below and that despite repeated time being granted by the court below, she is not even filing her written statement.
This Court has perused the order-sheet that has been enclosed with the writ petition and finds that on 30 October 2018, 29 November 2018, 22 December 2018, 11 January 2019 and 21 January 2019, time was repeatedly being granted to the defendant-respondent to file her written statement.
Considering the facts and circumstances of the case, it is directed that the court below shall decide the aforesaid case pending before it in accordance with law, as expeditiously as possible, without granting unnecessarily adjournments to either of the parties.
With the aforesaid observation, the writ petition is disposed of.
