On 15.03.2016 the following order was passed by the Court:-
"Heard learned counsel for the parties.
The petitioner herein has been transferred on administrative ground from Hardoi to Balia. He asserts that there is no complain against his functioning.
List/put on 18.03.2016 as fresh to enable the learned Standing Counsel to seek instructions as to the reasons for transfer of the petitioner and place the material before the Court on the next date".
On the basis of instructions the learned standing counsel indicated alleged involvement of the petitioner in some nefarious activities of fabricating documents in the Board Examination but no specific material or complaint has been placed before the Court which may point towards the guilt of the petitioner, however, as these are purely administrative matters and the authorities are best suited to draw their conclusion based on situation ends of justice would be met if the Director, Secondary Education U.P. is directed to consider the grievance of the petitioner after verifying the facts and considering the allegation and material available against the petitioner and take a decision regarding sustainability and justifiability of the transfer order based thereon within a period of three weeks from the a certified copy of this order is produced before him.
Till the decision is taken by the Director, Secondary Education U.P., or for a period of three weeks, whichever is earlier, no coercive action shall be taken against the petitioner.
The writ petition is disposed of in the aforesaid terms.
