Heard learned counsel for the applicant, learned AGA for the State and perused the record.
The present 482 Cr.P.C. application has been filed by the applicant with the prayer to direct the Court below to expedite the S.T. No.254 of 2016 (State Vs. Tilak Singh and 4 others) arising out of case crime no.254 of 2016, under Sections 147, 148, 149, 302, 307 IPC, P.S. Sadabad, District Hathras. pending in the Court of Additional District and Sessions Judge, Court No.4, Hathra, within a stipulated period.
It is contended by learned counsel for the applicant that the applicant is the first informant in the present case in which all the witnesses of fact have been examined during trial. However, the remaining formal witnesses and the Investigating Officer are not appearing before the Court despite issuance of notice by the Court below on account of which the trial is held-up. I have perused the order sheet.
In view of the aforesaid, the trial Judge is directed to adopt all coercive, stringent steps for securing attendance of the aforesaid two witnesses and decide the aforesaid trial as expeditiously as possible strictly in accordance with law, preferably within a period of six months from the date of production of a certified copy of the order without granting unnecessary adjournment to either of the parties, if there is no other legal impediment.
With the aforesaid observations, the application is finally disposed of.
