Petitioner claims to have been engaged as Assistant Technology Manager/Subject Matter Specialist and Technology Manager at block level on contractual basis in the year 2015. His engagement made initially for one year has been extended from time to time. Petitioner's grievance is that such engagement has not been renewed for the year 2018 on the basis of a report in which petitioner's work has not found satisfactory. According to petitioner such report fails to take note of correct facts, and in case corrects facts are taken note of, petitioner would be entitled to be considered for extension/renewal of contract. In that regard petitioner has also approached the Joint Director, Agriculture, by way of a representation which according to petitioner has remained pending and has not been bestowed any consideration so far.
Learned Standing Counsel states that factual issues raised by petitioner can be examined by the authority concerned, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of with a direction upon respondent no.3 to accord consideration to petitioner's representation dated 04.5.2018, contained in Annexure No.4 to the writ petition, copy whereof shall be submitted before the authority concerned alongwith certified copy of this order, within two weeks from today. In case such a representation is made, the authority concerned shall have the matter inquired, in accordance with law, and shall take an appropriate decision, within a further period of two months, thereafter.
It is made clear that the Court has not adjudicated the case on merits.
