Heard Shri V.D. Shukla, learned counsel for the petitioner and Shri Raghvendra Dwivedi, learned Standing Counsel for the State-respondents.
By means of this writ petition the petitioner has come to this Court challenging the order dated 5.11.2012 which order has been passed by the Collector pursuant to a direction issued by this Court in Writ Petition No. 12115 of 2012 in the case of Smt. Manorama Devi Vs. State of U.P. and others wherein the allegation was made against the wife of the petitioner that she has been selected as Anganwadi Karyakatri on account of income certificate being below the poverty line which was incorrect. This Court vide order dated 2.3.2012 directed the District Magistrate to look into the claim with regard to income certificate of the petitioner.
From the order impugned it appears that both, the petitioner in that writ petition, namely, Manorama Devi and Meena Devi wife of the present petitioner were given opportunity to appear before the Collector and both submitted their respective documentary evidence with regard to income certificate and the Collector has reached the conclusion that upon the evidence produced by both the persons it does appear that the petitioner has concealed certain information at the time obtaining income certificate and has given categorical findings as to what is the income of the petitioner and how much landed property the petitioner possess.
That being the case, the petitioner does appear to be above the poverty line income group.
That being the facts of the case and also the fact that the wife of the petitioner was given full opportunity before passing of the order, we are not inclined to interfere with the order impugned.
The writ petition lacks merit and it is, accordingly, dismissed.
