JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 47831 of 2002 Petitioner :- Pradeep Kumar Respondent :- Chairman, Basti Gramin Bank And Others Counsel for Petitioner :- Krishna Mohan Singh,A.K.Mishra Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of the petitioner to press this writ petition. Learned Standing Counsel is present for respondents.
2. By means of the present writ petition, petitioner has sought following reliefs:
"to allow the writ petition, issue appropriate writ, order or direction including the writ of mandamus commanding the respondents nos. 1 and 2 to make payment of his salary in the scale of Class III employee, to regularise the petitioner in Class III of the Gramin Bank under control and jurisdiction of the respondent nos. 1 and 2 and this Hon'ble Court may be further pleased to issue any other writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the present case."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 22.2.2019 KA
