From the records of the present writ petition, we find that without the girl, Kumari Hridesh being traced out, two of the named main accused, namely, Kuldeep and Smt. Laxmi have been acquitted by the Sessions Court, Mathura vide judgment and order dated 9th November, 2011.
Learned Additional Government Advocate informs the Court that no Government appeal has been filed against the judgment and order dated 9th November, 2011.
Let respondent no.2, the Director General of Police, U.P. Lucknow summon the record and examine for himself as to whether in the facts of the case, Government appeal should have been filed, specifically in the circumstance when the girl has not been recovered till date. If such appeal is required to be filed, he may issue instruction within 15 days of the receipt of a certified copy of this order, failing which he may disclose the reasons by means of an affidavit for the appeal being not preferred by the next date. For the purpose he may hold meeting with the District Government Counsel and District Magistrate concerned.
Let the matter come up again on 20th November, 2012.
