Following prayers are made in the writ petition:-
(i) issue a writ order or direction in the nature of certiorari for quashing the impugned order/decision dated 21.6.2018 taken by the Examination Committee against the petitioner's institution, which has been communicated by the respondent no. 3 to the petitioner vide letter dated 31.7.2018 (Annexure No. 18 to this writ petition).
(ii) issue a writ order or direction in the nature of mandamus commanding the respondents to consider and accept the application dated 02.11.2018 submitted by the petitioner Online for making the Examination Center for the U.P. Board Examination -2019 of the petitioner's institution."
The time for online nomination of examination centre has been provided in the Government Order dated 16.10.2018. The last date for submission of Online form for being nominated as examination centre was 24.10.2018.
The petitioner asserts in paragraph 50 of the writ petition that he had made an application on 02.11.2018, much after the last date for submission of the application.
The examination centres have been finalised by the respondent Board. At this belated stage no interference is called for. The petitioner cannot be permitted to apply for being nominated as an examination centre after the last date for submission of Online forms.
The writ petition is dismissed.
