The petitioner is before this Court assailing the order dated 05.02.2018 passed by third respondent i.e. District Inspector of Schools, Kushi Nagar (DIOS, Kushinagar) by which the claim of the petitioner for compassionate appointment has been discarded and the claim of sixth respondent was accepted.
Learned counsel for the petitioner submits that in the earlier round of litigation the Writ Petition No.55149 of 2000 (Pradeep Kumar Singh v. District Inspector of Schools, Kushinagar & Ors.) was disposed of on 11.12.2017 relegating the parties before the District Level Committee for examination of their claims after hearing all the parties concerned. As such it is contended that the order impugned passed by the DIOS is in teeth of the direction issued by this Court on 11.12.2017, wherein the Court has asked the District Level Committee to decide the claim set up by the parties.
Considering the facts and circumstances of the case, the writ petition stands disposed of asking the District Level Committee to consider and decide the controversy in response to the direction issued by this Court in the aforesaid writ petition after giving opportunity both to the petitioner as well as sixth respondent without being influenced by the order impugned within six weeks from the date of production of certified copy of this order. Learned counsel for the parties are in agreement that the order passed by the District Level Committee would be final and neither of the parties would assail the validity of the said order.
