The case is taken up through Video Conferencing.
Learned counsel for petitioner undertakes that he shall remove the defects pointed out by the Registry within a period of ten days of the withdrawal of lockdown restrictions.
Heard learned counsel for petitioner and Sri R.K. Singh Suryavanshi, learned counsel for O.P. No.5 and standing counsel for State.
Learned counsel for parties state that present matter is squarely covered by order dated 8.2.2021 passed in Writ Petition No.4719 (S/S) of 2021 (Rakesh Kumar Chaturvedi. Vs. State of U.P. and others.). The operative portion of the same reads as follows:-
"7. A perusal of the order of Supreme Court shows that the reliefs prayed by the petitioner herein cannot be considered separately and independently, the same are required to be considered by respondent Nos.1 to 4 in terms of the direction of the Supreme Court. It is, therefore, directed that the concerned opposite parties shall consider the benefits to which petitioner is entitled to, including with regard to continuance of service and payment of salary etc. in terms of the aforesaid judgment of the Supreme Court. Respondent Nos.1 to 4 are expected to take such a decision as expeditiously as possible.
8. With the aforesaid, present writ petition is disposed of. "
In view of the aforesaid statement, the present writ petition is also disposed of in the aforesaid terms. It is, therefore, directed that the concerned opposite parties shall consider the benefits to which petitioner is entitled to, including with regard to continuance of service and payment of salary etc. in terms of the aforesaid judgment of the Supreme Court. The concerned authorities are expected to take such a decision as expeditiously as possible.
