Heard Sri D.V. Jaiswal, counsel for the petitioner, Sri K.M. Asthana for respondent nos. 3 and 4, and Sri Ishan Shishu for respondent no. 5.
Present petition was filed challenging the order dated 04.06.2019 passed by the Presiding Officer Debts Recovery Tribunal, Allahabad.
By the order dated 19.06.2019 it was directed that the parties shall maintain status quo till 24.06.2019.
Today, Sri K.M. Asthana, counsel appearing for respondent nos. 3 and 4 submits that the petitioner is already availing remedy before the Debts Recovery Appellate Tribunal, Allahabad and the matter is posted for 17.07.2019.
Sri D.V. Jaiswal, counsel for the petitioner very fairly submits that the petition has become infructuous and he does not want to pursue the same.
In view of the above, the writ petition is dismissed. The interim order granted on 19.06.2019 is vacated.
