1. Heard learned counsel for petitioner and perused the record.
2. We are clearly of the view that no cause of action has arisen for this writ petition and this petition is wholly ill-advised and misconceived.
3. Impugned order only says that Executive Engineer shall proceed to recover Rs. 14,87,975/- treating it a civil liability by filing a case for recovery against petitioner. It is not the case of petitioner that any such civil suit has been filed for recovery, hence no cause of action has arisen at this stage and whenever any suit is filed, petitioner will have opportunity to contest the same but impugned order by itself does not give any cause of action to petitioner to challenge the same at this stage which only directs for institution of suit for recovery of certain amount.
4. Writ petition is accordingly dismissed in the light of aforesaid discussion.
