Heard Sri Pradeep Kumar Sharma, learned counsel for the petitioners and Sri Gyanendra Srivastava, learned Standing Counsel for the respondents.
The petitioners in the writ petition are seeking a direction to the respondents to provide compensation in terms of the Letter dated 11.04.2018.
Earlier the petitioners had filed Writ Petition No.11813 of 2016, Pradeep Kumar Gupta and 5 Others Vs. State of U.P. and 3 Others which was disposed of by the Court by order dated 16.03.2016 with a direction to the respondent no.2, District Magistrate to decide the petitioners' representation to give them compensation if the land of the petitioners is acquired for the purpose of canal. Thereafter the District Magistrate on 11.04.2018 directed the Executive Engineer, Flood Division, Bareilly to provide all the relevant records to the Special Land Acquisition Officer, so that the sale deed may be executed with the land owner. Learned counsel for the petitioners states that till date the petitioners have not been paid compensation.
No useful purpose would be served by keeping this writ petition pending.
The writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.2, District Magistrate, Bareilly to examine the matter and take appropriate action in accordance with law within a period of three months from the date a certified copy of this order is received in his office.
It is made clear that the Court has not adjudicated the claim of the petitioners on merits.
