This writ petition, inter alia, has been filed for the following reliefs:
"I. Issue a writ order or direction in the nature of certiorari quashing the impugned office memo dated 18.02.2019 passed by respondent No. 2 Annexure No. 1 to this writ petition.
II. Issue a writ order or direction in the nature of mandamus commanding the respondents to renew the schedule caste certificate dated 07.04.2000 issued by competent authority/Tehsildar Kol, Aligarh."
Heard the learned counsel for the parties and perused the record.
Learned counsel for the petitioner stated that the impugned order has been passed without giving any opportunity of hearing. To this, learned Standing Counsel appearing on behalf of the respondents drawn our attention to the impugned order dated 18.2.2019 and stated that the petitioner was given sufficient opportunity to represent his case.
Be that as it may, in case the petitioner is aggrieved with the impugned order, he has got an alternative remedy to file an appeal as provided in the Government Order dated 26.3.2011 in accordance with law.
In view of the above, we do not see any justification to interfere in the matter.
The writ petition is, accordingly, dismissed on the ground of alternative remedy. However, it is open for the petitioner to adduce any cogent evidence, if any, in support of his contention and take all legal pleas as permissible in law before the appellate authority. In case, the petitioner files an appeal within a period of 15 days from today, it shall be entertained ignoring the period of limitation and decided by the appellate authority expeditiously within a period of 30 days thereafter.
