Heard learned counsel for the applicant.
Applicant alleges non-compliance of order of writ Court dated 03.04.2014 passed in Writ Petition No. 2007 (S/S) of 2014 ( Pradeep Kumar Asthana Vs. Chief Election Officer, Lucknow and others), whereby the writ Court stayed the operation of order dated 04.02.2014 (Annexure no. 1 to the writ petition, by which the claim of the applicant for regularization of services was refused and his services were also terminated) till the next date of listing.
Submission of learned counsel for the applicant is that copy of the order of writ Court was sent to the opposite parties through registered post on 12.04.2014. It is also submitted that the Joint Chief Election Officer, Lucknow sought information with respect to applicant, from the District Election Officer, Bahraich vide letter dated 19.04.2014, but despite the stay of order dated 04.02.2014, applicant is not being allowed to put his signature on the attendance register as well as no salary is being paid to him. Therefore, the applicant is constrained to approach this Court by means of present Contempt Petition for initiating proceedings against the opposite parties under the provisions of Contempt of Court Act for willful disobedience of order dated 03.04.2014 of the writ Court.
On due consideration, prima facie, a case of willful disobedience of the order of writ Court is made out.
Let notice be issued to opposite parties, returnable at an early date to show cause as to why proceedings be not initiated against them under the provisions of Contempt of Court Act for willful disobedience of order of the writ Court dated 03.04.2014 passed in Writ Petition No. 2007 (S/S) of 2014 ( Pradeep Kumar Asthana Vs. Chief Election Officer, Lucknow and others).
