1. Heard Sri Rajnish Dubey, learned counsel for the applicant and Sri Ashwani Prakash Tripathi, learned A.G.A. for the State.
2. This anticipatory bail application has been filed on behalf of the applicant - Pradeep Awana, seeking anticipatory bail in Case Crime No.1177 of 2021, under Sections -323, 427, 504, 506, 325, 452 I.P.C., Police Station - Sector-20, District -Gautam Budh Nagar, during pendency of trial.
3. Learned counsel for the applicant submits that undisputedly there is a matrimonial discord in the marriage of the first informant with the applicant. Earlier, an FIR had been lodged by the applicant in Case Crime No.1795 dated 03.11.2018 making allegation of grievous hurt caused against the first informant (in this case) and others. Applicant has been falsely implicated on account of aforesaid reasons.
4. Having heard learned counsel for the parties and having perused the record, no good ground is made out to grant anticipatory bail as in occurrence the main role has been assigned to the applicant.
5. Accordingly, the present application is rejected. However, in the event of regular bail application being filed at the appropriate stage, it is expected that the same may be decided as expeditiously as possible, without being prejudiced by any observation made in this order.
