The Court has convened through Video Conferencing.
Heard Sri Virendra Kumar Shukla, learned counsel for the petitioners and Sri H.P. Srivastava, learned Additional Chief Standing Counsel the State is present.
The present writ petition has been filed by the petitioners with the following prayer:-
" (a) Issue a writ, order or direction in the nature of mandamus commanding/directing the opp. party no.4 to release the petitioners from jail for a period of one week for using their votes in election in the year 2021 of Village Panchayat Baraualiya, Pargana, Police Station Badosarai, Block Tehsil-Sirauligauspur, District Barabanki.
(b) Issue a writ, order or direction in the nature of mandamus commanding/directing the opp. party no.4 to ensure using votes on 26.4.2021 in police custody for election 2021 of Village Panchayat Baraualiya, Pargana, Police Station Badosarai, Block Tehsil-Sirauligauspur, District Barabanki "
After going through prayer made in the writ petition and the contents therein, we find that the Panchayat Election has already been held on 26.04. 2021 and no further cause of action survives, hence, the present writ petition has become infructuous.
Accordingly, the present writ petition is dismissed as having become infructuous with a liberty to the petitioner to avail appropriate legal remedy available to him under law.
The party shall file computer generated copy of order downloaded from the official website of High Court Allahabad, self attested by it alongwith a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of the computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
