Heard Sri Vikas Upadhyay, learned counsel for the petitioner, the learned AGA and perused the impugned F.I.R, as well as material brought on record.
The relief sought in this petition is for quashing of the F.I.R, dated 12.1.2019, registered as Case Crime No. 23 of 2019, under sections 420, 406, 467, 468, 471, 477-A, 120-B IPC P.S. Govind Nagar, District Kanpur Nagar.
The FIR lodged by HDFC Bank alleges that on 27.9.2018, loanee called Jyoti Tiwari was disbursed Rs.9,45,000/- of loan by the Gold Loan Officer Paras Pant against gold as security, which turned out to be fake, whereas on 29.9.2018, a sum of Rs.4,40,000/- was transferred from the account of Jyoti Tiwari to the account of petitioner wife of Paras Pant.
It is submitted by learned counsel for the petitioner that petitioner is a house wife, she had confided with her husband about aforesaid transaction, who cooked up an allegation as alleged in paragraph-7, no offence is made out, FIR is liable to be dismissed.
Learned A.G.A, rightly submitted that cognizable offences are disclosed, petition be dismissed.
The writ petition is dismissed.
