1. The present application u/s.482 of the Code of Criminal Procedure has been preferred by the applicants herein – original accused to quash and set aside the impugned FIR being C.R.No.I-12 of 2010 registered with Mavsari Police Station, Banaskantha lodged by the respondent No.2 herein for the offences punishable under Sections 384, 420, 406, 323, 504, 506(2), 114 and 511 of the Indian Penal Code.
2. After the matter was argued for sometime, Mr.Jigar Gadhavi, learned advocate appearing on behalf of the applicants, under the instruction from his clients, seeks permission to withdraw the present application. However, he has requested to reserve liberty in favour of the applicants to submit an appropriate application for discharge in case after investigation is concluded, the applicants are charge-sheeted.
3. In view of the above, the present application is dismissed as withdrawn with above liberty. After investigation is concluded and if the applicants are charge-sheeted and any application for discharge is submitted by the applicants, the same be considered by the concerned Magistrate/Court in accordance with law and on merits, without in any way being influenced by the present order of withdrawal. Rule is discharged. Ad-interim relief, if any, stands vacated forthwith.
