The prayer made in the present petition is to issue a direction to the Court below namely the Civil Judge (Senior Division), Sant Kabir Nagar, to decide the Misc. Case No. 75 of 2017 (Rajesh Kumar vs. Prabhawati and others) filed under Order 9 Rule 13 readwith Section 151 CPC in succession application namely Case No. 45 of 2014 (Prabhawati vs. Sayala).
The petitioner is opposite party in the recall application namely the Misc. Case No. 75 of 2017.

Without expressing any opinion on the merits of claim of the petitioner, the present petition is being disposed of with the direction to the Court below namely the Civil Judge (Senior Division), Sant Kabir Nagar to decide the Misc. Case No. 75 of 2017, expeditiously, preferably within a period of three months from the date of submission of certified copy of this order.
