Heard learned counsel for the petitioner and learned counsel for the respondent no. 1 as well as learned standing counsel for the State respondents.
The writ petition has been filed seeking a following relief:
"Issue a writ/order or direction in the nature of mandamus direct the Proforma respondent (Assistant Collector/Sub Divisional Magistrate Tehsil Sadar Jaunpur) to decide the case No. T20181436040 of 2015 filed under Section 176 U.P.Z.A.
L.R. Act, expeditiously as possible within stipulated period prescribed by this Hon'ble Court."
The contention of the learned counsel for the petitioner is that the partition suit filed in the year 2015 has not been decided till date. The proceedings are stated to be pending at the stage of evidence.
Under the circumstances, this writ petition is disposed of directing the respondent no. 26 to decide the proceedings upon the stage of preliminary decree as expeditiously as possible and preferably within a period of five months from the date of production of certified copy of this order.
